1. บทนำและการยอมรับข้อกำหนด

ข้อกำหนดและเงื่อนไขการใช้งานฉบับนี้ (“ข้อกำหนด”) กำหนดหลักเกณฑ์ เงื่อนไข และข้อจำกัดที่เกี่ยวข้องกับการเข้าถึงและการใช้งานเว็บไซต์ *.supassproject.workers.dev รวมถึงเนื้อหา ฟังก์ชัน ระบบ ซอฟต์แวร์ และบริการที่เกี่ยวข้อง ซึ่งต่อไปนี้จะเรียกรวมกันว่า “เว็บไซต์” โดยดำเนินการภายใต้ชื่อ “Supass Project” ซึ่งต่อไปนี้จะเรียกว่า “ผู้ให้บริการ”

การเข้าถึง เรียกดู หรือใช้งานเว็บไซต์ไม่ว่าด้วยวิธีการใด ถือว่าผู้ใช้รับทราบข้อกำหนดที่เกี่ยวข้องกับการใช้งานเว็บไซต์ ทั้งนี้ การมีผลผูกพันทางกฎหมายของข้อกำหนดแต่ละข้อให้เป็นไปตามกฎหมายที่ใช้บังคับและข้อเท็จจริงที่เกี่ยวข้อง

หากผู้ใช้ไม่ยอมรับข้อกำหนดฉบับนี้ ผู้ใช้ควรงดการเข้าถึงหรือหยุดใช้งานเว็บไซต์

ข้อกำหนดฉบับนี้ควรอ่านร่วมกับ Privacy Policy ซึ่งอธิบายแนวทางการเก็บรวบรวม ใช้ เปิดเผย และจัดการข้อมูลที่เกี่ยวข้องกับการใช้งานเว็บไซต์

ผู้ให้บริการอาจปรับปรุง เปลี่ยนแปลง เพิ่มเติม จำกัด หรือยุติเนื้อหาและฟังก์ชันบางส่วนหรือทั้งหมดได้ตามความเหมาะสม โดยคำนึงถึงข้อจำกัดทางเทคนิค ความปลอดภัย การบำรุงรักษา และข้อกำหนดของบริการที่เกี่ยวข้อง

เว้นแต่จะมีการระบุไว้อย่างชัดเจน เว็บไซต์ไม่ได้รับประกันว่าจะให้บริการได้อย่างต่อเนื่อง ไม่มีข้อผิดพลาด หรือรองรับอุปกรณ์ ระบบปฏิบัติการ และสภาพแวดล้อมทุกประเภท

การเข้าถึงเว็บไซต์ไม่ได้ทำให้ผู้ใช้ได้รับสิทธิในการเป็นเจ้าของ การควบคุม หรือสิทธิพิเศษใด ๆ เหนือระบบหรือโครงสร้างพื้นฐานของผู้ให้บริการ

4. คุณสมบัติและความรับผิดชอบของผู้ใช้

ผู้ใช้ตกลงที่จะใช้งานเว็บไซต์โดยสุจริตและเป็นไปตามข้อกำหนดฉบับนี้ รวมถึงกฎหมายและข้อบังคับที่ใช้บังคับ

ผู้ใช้ต้องรับผิดชอบต่อการใช้งานอุปกรณ์ เครือข่าย ซอฟต์แวร์ และข้อมูลที่ตนใช้เพื่อเข้าถึงเว็บไซต์ ตลอดจนผลที่เกิดจากการกระทำของตนภายในขอบเขตที่กฎหมายอนุญาต

ผู้ใช้ต้องไม่แอบอ้างเป็นบุคคลอื่น บิดเบือนข้อมูลสำคัญ หรือกระทำการใดที่มีวัตถุประสงค์เพื่อหลอกลวงผู้ให้บริการหรือบุคคลอื่น

5. การใช้งานที่ไม่ได้รับอนุญาต

ผู้ใช้ต้องไม่ดำเนินการหรือพยายามดำเนินการดังต่อไปนี้ เว้นแต่ได้รับอนุญาตโดยชัดแจ้งจากผู้ให้บริการหรือได้รับอนุญาตตามกฎหมาย

  1. ใช้เว็บไซต์เพื่อกระทำการที่ผิดกฎหมาย ฉ้อโกง คุกคาม หรือก่อให้เกิดความเสียหายแก่บุคคลอื่น
  2. เข้าถึงหรือพยายามเข้าถึงระบบ บัญชี พื้นที่จัดเก็บข้อมูล หรือส่วนประกอบที่ไม่ได้รับอนุญาต
  3. หลีกเลี่ยง ทำลาย หรือรบกวนมาตรการรักษาความปลอดภัย การควบคุมการเข้าถึง หรือกลไกป้องกันการใช้งานในทางที่ผิด
  4. ทดสอบช่องโหว่ สแกนระบบ หรือดำเนินการตรวจสอบความปลอดภัยในลักษณะที่ส่งผลกระทบต่อระบบโดยไม่ได้รับอนุญาต
  5. ส่งมัลแวร์ โค้ดอันตราย คำขอที่มีลักษณะโจมตี หรือข้อมูลที่ออกแบบมาเพื่อรบกวนการทำงานของเว็บไซต์
  6. ทำให้เว็บไซต์หรือโครงสร้างพื้นฐานที่เกี่ยวข้องทำงานหนักเกินควร รวมถึงการส่งคำขอจำนวนมากในลักษณะที่กระทบต่อความพร้อมใช้งาน
  7. คัดลอก ดัดแปลง เผยแพร่ หรือใช้เนื้อหาของเว็บไซต์ในลักษณะที่ละเมิดสิทธิในทรัพย์สินทางปัญญาหรือสิทธิอื่นของผู้มีสิทธิ
  8. ใช้ระบบอัตโนมัติในการเก็บข้อมูลหรือเข้าถึงเว็บไซต์ในลักษณะที่ฝ่าฝืนข้อกำหนดของเว็บไซต์หรือกฎหมายที่เกี่ยวข้อง
  9. แทรกแซงการทำงานของเว็บไซต์ หรือพยายามหลีกเลี่ยงข้อจำกัดทางเทคนิคที่กำหนดไว้
  10. ใช้เว็บไซต์เพื่อเผยแพร่เนื้อหาที่ผิดกฎหมาย หรือเพื่อสนับสนุนการกระทำที่ผิดกฎหมาย

รายการข้างต้นมีวัตถุประสงค์เพื่อกำหนดขอบเขตการใช้งานที่ยอมรับได้ ไม่ได้มีเจตนาห้ามกิจกรรมที่ได้รับอนุญาตโดยกฎหมายอย่างชัดเจน เช่น การวิจัยด้านความปลอดภัยที่ได้รับอนุญาตหรือการใช้สิทธิตามกฎหมายที่เกี่ยวข้อง

6. ทรัพย์สินทางปัญญา

เว้นแต่จะระบุไว้เป็นอย่างอื่น เนื้อหาและองค์ประกอบของเว็บไซต์อาจอยู่ภายใต้สิทธิในทรัพย์สินทางปัญญาของผู้ให้บริการ ผู้สร้างสรรค์ หรือผู้ให้สิทธิที่เกี่ยวข้อง

การเข้าถึงเว็บไซต์ไม่ได้หมายความว่าผู้ใช้ได้รับโอนกรรมสิทธิ์หรือได้รับใบอนุญาตให้ใช้เนื้อหาทั้งหมดโดยไม่มีข้อจำกัด

ชื่อ เครื่องหมายการค้า โลโก้ และเครื่องหมายอื่นที่ปรากฏบนเว็บไซต์อาจเป็นสิทธิของเจ้าของแต่ละราย การปรากฏของเครื่องหมายดังกล่าวไม่ได้หมายความว่ามีการรับรอง สนับสนุน หรือมีความสัมพันธ์ทางธุรกิจระหว่างผู้ให้บริการกับเจ้าของเครื่องหมายนั้น

หากผู้ใช้เชื่อว่าเนื้อหาบนเว็บไซต์ละเมิดสิทธิของตน ผู้ใช้สามารถติดต่อผู้ให้บริการผ่านช่องทางติดต่อที่เผยแพร่บนเว็บไซต์เพื่อแจ้งรายละเอียดที่เกี่ยวข้อง

7. เนื้อหาหรือข้อมูลที่ผู้ใช้ส่งให้

หากเว็บไซต์มีฟังก์ชันที่เปิดให้ส่งข้อความ ไฟล์ ความคิดเห็น หรือข้อมูลอื่น ผู้ใช้ยังคงเป็นผู้รับผิดชอบต่อเนื้อหาที่ตนส่งและสิทธิที่เกี่ยวข้องกับเนื้อหานั้น

ผู้ใช้รับรองว่าตนมีสิทธิหรือได้รับอนุญาตอย่างเหมาะสมในการส่งเนื้อหาดังกล่าว และการส่งเนื้อหานั้นไม่ละเมิดกฎหมายหรือสิทธิของบุคคลอื่น

เว้นแต่จะมีการระบุเป็นอย่างอื่นในเงื่อนไขเฉพาะของฟังก์ชันนั้น การส่งเนื้อหาไม่ได้ทำให้ผู้ใช้โอนกรรมสิทธิ์ในเนื้อหาให้แก่ผู้ให้บริการโดยอัตโนมัติ

ผู้ให้บริการอาจจำกัดการเข้าถึงหรือนำเนื้อหาออกเมื่อมีเหตุอันสมควร เช่น เมื่อเนื้อหาอาจผิดกฎหมาย ละเมิดสิทธิของบุคคลอื่น หรือส่งผลกระทบต่อความปลอดภัยและการทำงานของเว็บไซต์ ทั้งนี้ ภายใต้กฎหมายที่ใช้บังคับ

8. ความเป็นส่วนตัวและข้อมูลทางเทคนิค

การจัดการข้อมูลที่เกี่ยวข้องกับผู้ใช้เป็นไปตาม Privacy Policy ของเว็บไซต์ ซึ่งควรอ่านร่วมกับข้อกำหนดฉบับนี้

เว็บไซต์อาจใช้บริการวิเคราะห์การใช้งาน เช่น Umami Cloud เพื่อทำความเข้าใจรูปแบบการใช้งานและปรับปรุงเว็บไซต์ ทั้งนี้ ประเภทข้อมูลที่มีการเก็บรวบรวมขึ้นอยู่กับการตั้งค่าของเว็บไซต์และบริการที่ใช้งานจริง

ผู้ใช้ไม่ควรส่งข้อมูลส่วนบุคคลที่มีความอ่อนไหวหรือข้อมูลลับผ่านช่องทางที่ไม่ได้ออกแบบมาเพื่อรับข้อมูลดังกล่าว

การใช้บริการของบุคคลที่สามอาจอยู่ภายใต้ข้อกำหนดและนโยบายความเป็นส่วนตัวของผู้ให้บริการภายนอกนั้นด้วย

9. บริการและลิงก์ของบุคคลที่สาม

เว็บไซต์อาจมีลิงก์หรือส่วนประกอบที่เชื่อมต่อกับเว็บไซต์ แพลตฟอร์ม หรือบริการของบุคคลที่สาม เพื่ออำนวยความสะดวกหรือสนับสนุนการทำงานของเว็บไซต์

ผู้ให้บริการไม่ได้ควบคุมเนื้อหา นโยบาย ความพร้อมใช้งาน หรือแนวทางการจัดการข้อมูลของบุคคลที่สามทั้งหมด การเข้าถึงบริการเหล่านั้นจึงอาจอยู่ภายใต้ข้อกำหนดแยกต่างหาก

การปรากฏของลิงก์หรือบริการดังกล่าวไม่ได้ถือเป็นการรับรองความถูกต้อง ความปลอดภัย หรือความเหมาะสมของบริการนั้นโดยอัตโนมัติ

ผู้ใช้ควรตรวจสอบข้อกำหนดและนโยบายที่เกี่ยวข้องก่อนใช้บริการภายนอก โดยเฉพาะเมื่อมีการส่งข้อมูลส่วนบุคคลหรือข้อมูลที่เป็นความลับ

10. ความพร้อมใช้งาน การบำรุงรักษา และการเปลี่ยนแปลง

ผู้ให้บริการอาจดำเนินการบำรุงรักษา ปรับปรุง แก้ไขข้อผิดพลาด หรือเปลี่ยนแปลงโครงสร้างของเว็บไซต์ตามความจำเป็น

การดำเนินการดังกล่าวอาจทำให้เว็บไซต์หรือฟังก์ชันบางส่วนไม่สามารถใช้งานได้ชั่วคราว หรืออาจส่งผลให้เนื้อหาและความสามารถบางอย่างเปลี่ยนแปลงไป

แม้ผู้ให้บริการจะพยายามดูแลให้เว็บไซต์ทำงานได้ตามวัตถุประสงค์ แต่ไม่อาจรับประกันได้ว่าจะไม่มีการหยุดชะงัก ความล่าช้า ข้อผิดพลาด หรือเหตุขัดข้องจากระบบเครือข่ายและผู้ให้บริการภายนอก

ผู้ใช้ควรเก็บสำเนาข้อมูลที่จำเป็นไว้ด้วยตนเอง หากข้อมูลดังกล่าวมีความสำคัญและมีช่องทางให้สำรองข้อมูลได้

11. การปฏิเสธการรับประกัน

ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต เว็บไซต์และเนื้อหาที่ให้บริการจัดทำขึ้นตามสภาพที่มีอยู่และตามความพร้อมใช้งาน เว้นแต่จะมีการระบุเป็นอย่างอื่นอย่างชัดแจ้ง

ผู้ให้บริการไม่รับประกันโดยชัดแจ้งหรือโดยปริยายว่าเว็บไซต์จะเหมาะสมกับวัตถุประสงค์เฉพาะของผู้ใช้ ถูกต้องครบถ้วน ปราศจากข้อผิดพลาด ปลอดภัยอย่างสมบูรณ์ หรือพร้อมใช้งานตลอดเวลา

ข้อมูลหรือเนื้อหาที่เผยแพร่บนเว็บไซต์อาจไม่ครอบคลุมสถานการณ์ทั้งหมด และอาจต้องได้รับการตรวจสอบเพิ่มเติมก่อนนำไปใช้ตัดสินใจหรือใช้งานในบริบทที่มีความสำคัญ

ข้อกำหนดในส่วนนี้ไม่ตัดสิทธิหรือจำกัดการรับประกันที่กฎหมายห้ามยกเว้นหรือจำกัดไว้

12. ข้อจำกัดความรับผิด

ภายในขอบเขตที่กฎหมายอนุญาต ผู้ให้บริการจะไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายพิเศษ ความเสียหายที่เป็นผลสืบเนื่อง การสูญเสียกำไร การสูญเสียข้อมูล การหยุดชะงักทางธุรกิจ หรือความเสียหายอื่นที่เกิดจากหรือเกี่ยวข้องกับการเข้าถึงหรือใช้งานเว็บไซต์ หากกฎหมายอนุญาตให้จำกัดความรับผิดดังกล่าวได้

ไม่มีข้อความใดในข้อกำหนดนี้ที่มีเจตนาตัดความรับผิดซึ่งไม่สามารถยกเว้นหรือจำกัดได้ตามกฎหมายที่ใช้บังคับ

การใช้ข้อจำกัดความรับผิดต้องตีความตามข้อเท็จจริงและกฎหมายที่เกี่ยวข้อง และไม่ถือเป็นการรับรองว่าข้อจำกัดทุกประการจะใช้บังคับได้ในทุกเขตอำนาจศาล

13. การชดใช้ความเสียหาย

ภายในขอบเขตที่กฎหมายอนุญาต ผู้ใช้อาจต้องรับผิดชอบต่อความเสียหาย การเรียกร้อง หรือค่าใช้จ่ายที่เกิดจากการใช้งานเว็บไซต์โดยฝ่าฝืนข้อกำหนด การละเมิดสิทธิของบุคคลอื่น หรือการกระทำที่ผิดกฎหมายของผู้ใช้

ผู้ให้บริการอาจจำกัด ระงับ หรือยุติการเข้าถึงเว็บไซต์หรือฟังก์ชันบางส่วน เมื่อมีเหตุอันสมควร เช่น

การระงับหรือยุติการเข้าถึงอาจเกิดขึ้นชั่วคราวหรือถาวรตามลักษณะของเหตุการณ์และข้อจำกัดที่เกี่ยวข้อง

เมื่อมีความเหมาะสม ผู้ให้บริการอาจแจ้งเหตุผลหรือแนวทางแก้ไขให้ผู้ใช้ทราบ แต่ไม่รับประกันว่าจะสามารถแจ้งล่วงหน้าได้ในทุกกรณี โดยเฉพาะกรณีที่เกี่ยวข้องกับความปลอดภัยหรือข้อกำหนดทางกฎหมาย

15. การเปลี่ยนแปลงข้อกำหนด

ผู้ให้บริการอาจแก้ไข ปรับปรุง หรือเพิ่มเติมข้อกำหนดฉบับนี้ตามความจำเป็น เพื่อให้สอดคล้องกับการเปลี่ยนแปลงของเว็บไซต์ เทคโนโลยี การดำเนินงาน หรือกฎหมายที่เกี่ยวข้อง

16. กฎหมายที่ใช้บังคับและการระงับข้อพิพาท

ข้อกำหนดฉบับนี้ให้ตีความและบังคับใช้ตามกฎหมายที่มีผลใช้บังคับกับผู้ให้บริการและการใช้งานเว็บไซต์ โดยคำนึงถึงบทบัญญัติบังคับของกฎหมายที่เกี่ยวข้อง

หากเกิดข้อพิพาทจากหรือเกี่ยวข้องกับข้อกำหนดฉบับนี้ คู่กรณีอาจพยายามแก้ไขข้อพิพาทโดยสุจริตผ่านการติดต่อสื่อสารก่อนดำเนินการตามกระบวนการที่กฎหมายกำหนด

ข้อกำหนดฉบับนี้ไม่ได้กำหนดเขตอำนาจศาลหรือกฎหมายเฉพาะประเทศโดยเด็ดขาด เนื่องจากต้องพิจารณาสถานะของผู้ให้บริการ สถานที่ดำเนินงาน และข้อเท็จจริงที่เกี่ยวข้องก่อน

17. การแยกส่วนของข้อกำหนด

หากข้อกำหนดข้อใดถูกวินิจฉัยว่าไม่ชอบด้วยกฎหมาย ไม่สามารถใช้บังคับได้ หรือไม่มีผลบังคับใช้ทั้งหมดหรือบางส่วน ให้ข้อกำหนดส่วนนั้นมีผลเท่าที่กฎหมายอนุญาต และไม่กระทบต่อข้อกำหนดส่วนที่เหลือ เว้นแต่กฎหมายกำหนดไว้เป็นอย่างอื่น

การที่ผู้ให้บริการไม่ใช้สิทธิหรือไม่ดำเนินการตามข้อกำหนดข้อใดในทันที ไม่ถือเป็นการสละสิทธิในข้อกำหนดนั้นโดยอัตโนมัติ

18. ข้อตกลงทั้งหมดและการไม่สละสิทธิ

ข้อกำหนดฉบับนี้และเอกสารนโยบายที่เกี่ยวข้องซึ่งมีการอ้างถึงอย่างชัดแจ้ง ให้ใช้เป็นกรอบสำหรับการใช้งานเว็บไซต์ในเรื่องที่เอกสารเหล่านั้นครอบคลุม
